These Terms and Conditions set out the basis on which Man and Van South Kensington provides removal and associated services. By booking or using our services you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below.

1.1 Service means any man and van, removal, transportation, loading, unloading, packing, or related service provided by us.

1.2 Customer means the person, firm, or company who requests or agrees to purchase the Service.

1.3 Vehicle means any vehicle used by us to provide the Service.

1.4 Goods means all items, effects, and property that we are requested to move, transport, or handle in the course of the Service.

1.5 Contract means the agreement between the Customer and Man and Van South Kensington for the provision of the Service, as set out in these Terms and Conditions and in any written confirmation we provide.

2. Scope of Services

2.1 We provide man and van and removal services for domestic and commercial customers, including loading, transport, and unloading of Goods within our service area and beyond, as agreed at the time of booking.

2.2 Unless specifically agreed in writing, our Service does not include disconnection or reconnection of appliances, dismantling or reassembly of furniture, or the removal of doors, windows, or fixtures in any property.

2.3 Any additional tasks requested on the day of the move will be carried out at our discretion and may be subject to additional charges.

3. Booking Process

3.1 Bookings may be made by the Customer by completing our booking process as described on our website or as otherwise communicated by us.

3.2 At the time of booking you must provide accurate information, including collection and delivery addresses, access details, the nature and approximate volume of Goods, any items of unusual size or weight, any parking restrictions, and any time constraints.

3.3 Our quote is based on the information provided by you. If the information is incomplete or inaccurate we may adjust the price accordingly or decline to provide some or all of the Service.

3.4 A booking is only confirmed when we have issued a written or electronic confirmation. We reserve the right to refuse any booking at our sole discretion.

4. Price and Payment

4.1 Prices are quoted either as an hourly rate or as a fixed price for the Service, as specified in our quote and confirmation.

4.2 Unless otherwise stated, our prices exclude any additional costs such as congestion charges, tolls, parking fees, or fines incurred due to circumstances beyond our control. Such costs will be payable by the Customer in addition to the quoted price.

4.3 We may require a deposit to secure the booking. Details of any required deposit and payment schedule will be communicated at the time of booking.

4.4 Payment terms will be stated in the booking confirmation. Unless otherwise agreed, payment is due on completion of the Service and must be made in full by an accepted payment method.

4.5 If payment is not made when due, we reserve the right to charge interest on overdue amounts at a reasonable commercial rate until payment is received in full.

4.6 We reserve the right to withhold delivery of Goods until full payment has been received. In such circumstances, any additional storage or waiting costs will be charged to the Customer.

5. Changes to Bookings

5.1 If you need to change the date, time, addresses, or scope of the Service you must inform us as soon as possible.

5.2 We will use reasonable efforts to accommodate requested changes but cannot guarantee availability. Changes may result in an adjustment to the price.

5.3 If you reduce the scope of the Service on the day of the move, we reserve the right to charge the full amount quoted if we have allocated time and resources based on your original booking.

6. Cancellations and Waiting Time

6.1 You may cancel your booking by giving us notice in accordance with this clause.

6.2 If you cancel more than 72 hours before the scheduled start time, any deposit paid may be refundable at our discretion, less any reasonable administrative costs.

6.3 If you cancel within 72 hours but more than 24 hours before the scheduled start time, we may charge up to 50 percent of the quoted price.

6.4 If you cancel within 24 hours of the scheduled start time, or fail to be present at the collection address at the agreed time, we may charge up to 100 percent of the quoted price.

6.5 If we arrive at the collection or delivery address and are unable to gain access or commence work due to circumstances beyond our control, waiting time may be charged at our standard hourly rate.

6.6 We may cancel or postpone the Service due to events outside our control, including severe weather, vehicle breakdown, accidents, illness, or other unforeseen circumstances. In such cases we will seek to rearrange the Service at a mutually convenient time. Our liability in these circumstances is limited to the refund of any deposit or prepayment for Services not performed.

7. Customer Responsibilities

7.1 You are responsible for

a ensuring that we have suitable and safe access to the collection and delivery locations, including parking arrangements and any required permits

b ensuring that Goods are properly packed and ready for transport, unless packing services have been separately agreed

c securing or removing any loose or fragile fittings that may be affected by the Service

d advising us in advance of any Goods that are particularly fragile, valuable, or heavy

e supervising the Service or appointing a representative to do so and to sign any relevant documentation.

7.2 You must not ask our staff to undertake any action that is unsafe, unlawful, or contrary to these Terms and Conditions.

7.3 If our staff consider that any premises or access points are unsafe, or that moving a particular item would be unsafe or likely to cause damage, they may refuse to carry out that part of the Service.

8. Goods that Cannot Be Transported

8.1 We will not transport the following types of Goods

a hazardous, flammable, explosive, or corrosive materials

b illegal or stolen goods

c cash, securities, or precious stones

d live animals or plants

e perishable goods that may deteriorate during transport

f any other items notified by us as prohibited.

8.2 If such Goods are transported without our knowledge, we accept no liability for any loss, damage, or consequence arising and you will indemnify us against any claims, costs, or damages that result.

9. Parking, Access, and Charges

9.1 You are responsible for arranging suitable parking and access for our Vehicle at both collection and delivery locations, and for any associated costs or permits.

9.2 If we incur parking fines, congestion charges, tolls, or similar costs as a direct result of providing the Service, these may be charged to you in addition to the quoted price.

9.3 We are not responsible for delays, additional time, or additional costs caused by poor or restricted access, blocked entrances, lifts out of order, or similar issues. Any additional time spent will be charged at our standard rates.

10. Waste and Disposal Regulations

10.1 We operate in accordance with applicable waste and environmental regulations. We are not a general waste disposal company and will not remove household or commercial waste unless specifically agreed as part of a separate service that complies with relevant regulations.

10.2 Any removal or disposal of unwanted items must be agreed in advance. Additional charges will apply for disposal or recycling of items.

10.3 We will not remove or dispose of hazardous waste, including but not limited to chemicals, asbestos, medical waste, fuel, or any regulated materials.

10.4 Where we agree to remove items for disposal, we will use appropriate authorised facilities in accordance with relevant regulations. Once such items are handed over to us for disposal, ownership passes to us and you may not request their return.

10.5 You are responsible for ensuring that any items presented for disposal are lawfully yours to dispose of and do not infringe the rights of any third party.

11. Our Liability

11.1 We will exercise reasonable care and skill in providing the Service. However, our liability is subject to the limitations set out in these Terms and Conditions.

11.2 We are not liable for any loss or damage arising from

a your failure to pack Goods properly, unless we have provided a packing service

b normal wear and tear or minor scratches and scuffs incurred during handling or transport

c goods packed in unsuitable containers or boxes

d inherent defects or vulnerabilities in Goods, including assembled flat pack furniture transported in an assembled state

e your failure to remove or secure fixtures, fittings, or fittings of sentimental or high value.

11.3 Our liability for loss of or damage to Goods, whether caused by negligence, breach of contract, or otherwise, is limited to the reasonable market value of the damaged Goods or a reasonable repair cost, whichever is lower, and subject to an overall cap which will be notified to you where applicable.

11.4 We will not be liable for

a indirect or consequential loss, including loss of profit, loss of business, or loss of opportunity

b loss or damage arising from delays due to traffic, weather, or other events beyond our reasonable control

c loss or damage arising where you or a third party have instructed us to proceed despite advice that damage may occur.

11.5 You must notify us in writing of any loss or damage you believe has occurred as a result of our Service as soon as reasonably possible and in any event within seven days of completion of the Service. We may inspect the alleged damage before any repair or disposal of the Goods.

12. Insurance

12.1 We maintain insurance appropriate for a man and van and removal service business. Details may be provided on request.

12.2 You are strongly advised to arrange your own insurance for Goods in transit, particularly for high value or fragile items, as our liability may be limited and may not cover the full replacement value of your Goods.

13. Delays and Events Beyond Our Control

13.1 We will make reasonable efforts to adhere to agreed dates and times, but time is not of the essence in the performance of the Service unless expressly agreed in writing.

13.2 We are not responsible for delays or failure to perform the Service caused by events outside our reasonable control, including but not limited to traffic congestion, road closures, accidents, severe weather, breakdown, or industrial action.

13.3 If an event beyond our control occurs, we may suspend the Service for the duration of the event and rearrange the Service as soon as reasonably practicable.

14. Complaints

14.1 If you have any concerns or complaints regarding our Service, you should raise them with our representative as soon as possible during the Service.

14.2 If the matter is not resolved at the time, you should submit a written complaint as soon as reasonably practicable, setting out the details of your concern.

14.3 We will investigate your complaint and respond within a reasonable timeframe. Where appropriate, we may propose a remedy or goodwill gesture, without prejudice to our rights under these Terms and Conditions.

15. Privacy and Data Protection

15.1 We will collect and process personal information about you in order to provide the Service, manage bookings, and handle payments and administration.

15.2 We will handle your personal information in accordance with applicable data protection laws and only retain it for as long as reasonably necessary for our business and legal purposes.

15.3 By using our services, you consent to our use of your personal information for the purposes of providing and improving our Service and communicating with you about your booking.

16. Termination

16.1 We may terminate the Contract or suspend the Service immediately if

a you fail to pay any sum when due

b you commit a serious or persistent breach of these Terms and Conditions

c we reasonably consider that it would be unsafe, unlawful, or inappropriate to continue the Service.

16.2 Upon termination, any sums owed by you for Services already provided or costs incurred will become immediately due and payable.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions and any Contract between you and us are governed by and construed in accordance with the laws of England and Wales.

17.2 You and we agree that the courts of England and Wales will have exclusive jurisdiction to settle any disputes or claims arising out of or in connection with these Terms and Conditions, the Contract, or the Service.

18. General Provisions

18.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

18.2 No variation of these Terms and Conditions will be binding unless agreed by us in writing.

18.3 No failure or delay by us in exercising any right or remedy under these Terms and Conditions will operate as a waiver of that right or remedy.

18.4 These Terms and Conditions, together with any written confirmation or quote provided, constitute the entire agreement between you and us relating to the Service and supersede any previous discussions or agreements.
